Are State Bar Associations Allowing Felons To Practice Law?

Does favoritism exist in our State Bar Associations, and does favoritism allow attorneys who are convicted felons to continue to practice law?

That’s the one of the topics explored in Show 75 of the highly acclaimed podcast “You Are The Guest”. Sam and Deidre are law partners from Alabama and both share their personal and professional opinions on politics, lawyers, attorney ethics, and some potential legal issues surrounding the death of Anna Nicole Smith. Host Bill Grady asks Sam and Deidre their opinion concerning Howard K. Stern's ethical behavior as a practicing

attorney and tosses out various scenarios to find out if they think there could be grounds for a civil suit if someone wanted to pursue them.

Sam shares a couple of stories about how the State Bar Associations can be selective in who they allow to practice law and whom they decide to go after. During Show 75 of “You Are The Guest”, Sam tells about a judge who was convicted of trading sex for favorable divorce rulings. The judge was kicked off the bench but still practices as a lawyer. As Sam explains the during the show, “What he did, he did as a judge and not as a lawyer.”

Sam also talks about another example of a lawyer who was convicted of dealing drugs while District Attorney and served 5 years in prison. When the convicted lawyer and former District Attorney was released from prison he applied for his license to practice law and attained one. The convicted felon continued to practice law for years until his retirement.
